Terms of Use

1. Eligibility and Accounts

Age Requirement: You must be at least 13 years of age to use GameStudy. If you are under 18, you represent that you have your parent or guardian's permission to use the App. Some countries set a higher age for consenting to the processing of personal data; if you live in one of them and are below that age, a parent or guardian must consent on your behalf. A parent or guardian who permits a minor to use the App agrees to these Terms on that minor's behalf and is responsible for their use of it. See the Privacy Policy for how we handle a minor's information.

Account Creation: To use the App, you must register for an account. We offer social login options via Google and Apple. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

No Guest Access: Full access to GameStudy's features requires a registered account.

2. Subscriptions and Payments

Billing: All subscriptions and payments are processed through the Apple App Store. You agree to comply with all relevant Apple terms and conditions.

Subscription Tiers:

• Weekly Subscription: Includes a 3-day free trial. You will be charged the weekly fee automatically at the end of the trial unless you cancel via your Apple ID settings at least 24 hours before the trial expires.
• Annual Subscription: Includes a 7-day free trial. You will be charged the annual fee automatically at the end of the trial unless you cancel via your Apple ID settings at least 24 hours before the trial expires.

Refunds: All refund requests must be directed to Apple. We do not process refunds directly.

3. AI Disclaimer and Content

AI Accuracy: GameStudy is an AI-powered language companion. You acknowledge that AI can "hallucinate" or provide inaccurate translations, grammatical errors, or factual misinformation. GameStudy is a learning aid, not a substitute for professional instruction or official documentation.

Screen Sensing & Voice Data: By using GameStudy, you grant us permission to:

• Sensing: View and process the text and visuals on your screen while the App is active to provide contextual language learning.
• Voice: Record and transcribe your voice input to analyze speech and provide feedback.

Usage: You agree that we may use this data to improve our AI models and provide your personalized learning experience.

4. Intellectual Property

What We Own: The App and everything in it, including the games, characters, artwork, animation, voices, audio, lesson content, text, software and underlying models, is owned by Kai AI Labs or its licensors and is protected by copyright, trademark and other laws. "GameStudy", "Kai", our logos and our characters are our trademarks. Nothing in these Terms transfers any of that to you.

What You May Do: We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial language learning, for as long as you comply with these Terms.

What You May Not Do: You may not copy, modify, translate, distribute, sell, rent, sublicense or create derivative works from the App or its content; reverse-engineer, decompile or disassemble it except where that right cannot lawfully be excluded; remove or obscure any proprietary notice; or use our name, logos or characters without our written permission.

Your Content: You keep ownership of what you say, write and submit while using the App. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, reproduce and adapt that content for the purposes described in our Privacy Policy: running the service, giving you feedback on your speaking, saving your progress, and improving our learning features. That license ends when you delete the content or your account, except for de-identified data as described in the Privacy Policy.

Feedback: If you send us ideas or suggestions about the App, we may use them freely and without any obligation to you.

5. Prohibited Conduct

You agree not to engage in any of the following:

• AI Manipulation: Attempting to "jailbreak," bypass safety filters, or reverse-engineer GameStudy's AI models or personality guardrails.
• Automated Access: Using bots, scrapers, or automated scripts to interact with GameStudy.
• Academic Dishonesty: Using GameStudy to cheat on proctored exams or graded assignments where prohibited by your institution.
• Privacy Violations: Using the screen-sensing feature to capture or store the private or sensitive information of third parties without their consent.

6. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms, including but not limited to:

• Violation of the Prohibited Conduct section.
• Failure to pay subscription fees via the App Store.
• Using the service in a way that creates a safety risk for other users or the platform.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAI AI LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

In plain terms: we do not promise that the App will be uninterrupted, secure or error-free, that defects will be corrected, or that the AI's output will be accurate. We do not promise any particular learning outcome. How much your language improves depends on how you use the App and on many things outside our control, and nothing in the App, on our website or in our marketing is a guarantee that you will reach a given level of fluency.

Some jurisdictions do not allow the exclusion of implied warranties or of certain consumer rights. Where that is so, the exclusions above apply only to the extent the law permits, and you may have rights that these Terms cannot take away.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAI AI LABS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU TO KAI AI LABS FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in New York, NY.

10. Third-Party Services

GameStudy uses YouTube API Services to embed video clips inside vocabulary lessons. By using GameStudy, you also agree to be bound by the YouTube Terms of Service at https://www.youtube.com/t/terms.

11. Apple App Store Terms

Because you obtained the App through the Apple App Store, the following also applies.

• This Agreement Is With Us, Not Apple: These Terms are between you and Kai AI Labs only. Apple is not a party to them, and Kai AI Labs, not Apple, is solely responsible for the App and its content.
• Scope of License: Your license to use the App is limited to a non-transferable license to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and Support: Kai AI Labs is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
• Warranty: Kai AI Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product Claims: Kai AI Labs, not Apple, is responsible for addressing any claim relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and any claim arising under consumer protection, privacy or similar legislation.
• Intellectual Property Claims: If a third party claims that the App infringes their intellectual property rights, Kai AI Labs, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
• Legal Compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Terms: You must comply with any applicable third-party terms of agreement when using the App.
• Developer Contact: Any question, complaint or claim about the App should be directed to Kai AI Labs, Inc., 320 W 38th St, New York, NY 10018, United States, or joseph@gamestudy.ai.

Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.
